These Terms & Conditions (“Terms”) govern your use of the Mozget Studio website and the services provided by Mozget Studio (“Mozget”, “we”, “us” or “our”). By accessing our website, submitting an enquiry, or engaging us for any service, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. About us
Mozget Studio is a full-stack digital product studio based in Greater Noida, Uttar Pradesh, India, offering web development, app development, digital marketing, graphic design, video editing, UI/UX, branding and SEO services.
2. Services & quotations
The specific scope, deliverables, timelines and fees for any engagement will be agreed in a proposal, quotation, statement of work or written communication (each an “Order”). Any Order forms part of these Terms. Quotations are valid for the period stated in them and are based on the requirements known at the time; changes to scope may affect fees and timelines.
3. Service delivery
We deliver our services digitally and remotely. Deliverables are provided electronically — for example via email, a shared drive, a project management tool, a code repository, or by deployment to your chosen hosting environment. Estimated timelines are provided in each Order and depend on the timely provision of content, feedback, approvals and access by you. We are not responsible for delays caused by incomplete information, late approvals or third-party dependencies outside our control.
4. Client responsibilities
- Provide accurate, complete and lawful content, materials and instructions.
- Review deliverables and provide feedback and approvals within reasonable timeframes.
- Ensure you hold the necessary rights to any materials you supply to us.
- Make payments in accordance with the agreed schedule.
5. Fees & payment
Fees are set out in the applicable Order and are payable in the manner and schedule stated there (which may include an advance or milestone-based payments). Unless stated otherwise, fees are exclusive of applicable taxes, which will be added where required. Payments are processed through third-party payment gateways such as Razorpay, PayU and PayGlocal; by paying, you also agree to the applicable gateway’s terms. We reserve the right to pause work where payments are overdue.
6. Refunds & cancellation
Refunds and cancellations are governed by our Refund & Cancellation Policy. In summary, a refund may be requested within the first fifteen (15) calendar days of payment or project commencement; after this window, no refund is applicable. Please read the full policy for details.
7. Intellectual property
Unless otherwise agreed in writing, ownership of final deliverables created specifically for you transfers to you upon receipt of full payment for the relevant work. Until then, all work product remains our property. We retain ownership of our pre-existing materials, tools, frameworks and know-how, and may showcase completed work in our portfolio and marketing unless you request otherwise in writing. Third-party assets (such as fonts, stock media, plugins or libraries) remain subject to their own licences.
8. Confidentiality
Each party agrees to keep confidential any non-public information shared during an engagement and to use it only for the purpose of performing or receiving the services.
9. Warranties & disclaimers
We provide our services with reasonable skill and care. Except as expressly stated, our services and website are provided “as is” without warranties of any kind, whether express or implied. We do not warrant that the website will be uninterrupted or error-free, or that our services will achieve any particular commercial result (for example specific rankings, traffic or sales), as these depend on many factors outside our control.
10. Limitation of liability
To the maximum extent permitted by law, Mozget Studio shall not be liable for any indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or in connection with an engagement shall not exceed the total fees paid by you to us for that specific engagement.
11. Third-party services & links
Our services may rely on, and our website may link to, third-party platforms and tools (such as hosting, analytics, advertising and payment providers). We are not responsible for the availability, content or practices of those third parties, which are governed by their own terms.
12. Indemnity
You agree to indemnify and hold Mozget Studio harmless from any claims, damages or expenses arising out of your breach of these Terms or from materials you provide to us that infringe the rights of any third party.
13. Suspension & termination
Either party may terminate an engagement in accordance with the applicable Order. We may suspend or terminate services, or your access to our website, where you breach these Terms, fail to pay, or use the services unlawfully. Termination does not affect accrued rights or payment obligations for work already performed.
14. Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to any applicable law, the courts at Gautam Buddh Nagar (Greater Noida), Uttar Pradesh, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
15. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page with an updated “Last updated” date, and continued use of our website or services after changes constitutes acceptance of the revised Terms.
